Dealer Terms & Conditions

These terms apply to motor traders and businesses advertising vehicles through FastCarsDealer.co.uk.

1. Dealer Account

Dealers must provide accurate business and contact information when creating an account.

We may request information reasonably required to verify the identity and business status of a dealer.

Dealers must keep their account information accurate and up to date and are responsible for protecting their login details.

2. Vehicle Advertisements

Dealers are responsible for ensuring that every advertisement is accurate, lawful and not misleading.

Vehicle descriptions must accurately represent, where applicable:

  • make and model;
  • registration year;
  • mileage;
  • price;
  • specification;
  • fuel and transmission type;
  • vehicle condition;
  • material history or information that must legally be disclosed; and
  • any other information required by applicable UK law.

Dealers must not deliberately hide material information that could affect a buyer's transactional decision.

3. Vehicle Prices

Prices displayed to consumers must be clear and must not be misleading.

Dealers are responsible for ensuring that compulsory charges are properly disclosed and for complying with applicable UK price-transparency requirements.

4. Ownership and Authority

A dealer must have the legal right or appropriate authority to advertise each vehicle listed through the marketplace.

Stolen vehicles, cloned vehicles, fraudulent advertisements and advertisements submitted without appropriate authority are prohibited.

5. Dealer Finance

Independent dealers are solely responsible for finance they advertise, introduce or arrange in connection with their vehicles.

Where applicable, dealers must hold or operate under all FCA permissions, appointments or exemptions required for their activities.

Fast Cars Dealer does not provide FCA permissions to independent dealers merely because they advertise vehicles on the marketplace.

Dealers must ensure that financial promotions and finance information appearing in their advertisements comply with applicable law and regulatory requirements.

Fast Cars Dealer may remove finance information or an advertisement where we reasonably believe that it may breach applicable requirements.

6. Fast Cars Dealer Finance

Finance arrangements made available by Fast Cars Dealer for vehicles sold directly by Fast Cars Dealer are separate from finance offered by independent marketplace dealers.

Independent dealers may not advertise themselves as being covered by Fast Cars Dealer's finance arrangements, FCA status, appointed representative arrangements or finance providers without prior written authorisation.

7. Dealer Responsibilities

The selling dealer is responsible for:

  • communicating with prospective buyers;
  • arranging vehicle inspections and test drives;
  • taking payment for the vehicle;
  • completing the vehicle sale;
  • providing legally required documentation;
  • handling warranties offered by the dealer;
  • dealing with complaints concerning the vehicle;
  • complying with applicable consumer rights; and
  • handling its own finance arrangements.

8. Marketplace Role

Fast Cars Dealer provides an advertising and marketplace service.

Unless Fast Cars Dealer is expressly identified as the seller of a particular vehicle, Fast Cars Dealer is not the seller and does not become a party to the vehicle purchase contract between an independent dealer and buyer.

Nothing in these terms excludes or restricts liability where doing so would be unlawful.

9. Fees

Dealers must pay the advertising or subscription fees shown when purchasing the applicable marketplace package.

Any introductory or promotional period will be subject to the conditions stated with that offer.

Current prices and packages will be displayed on the website.

10. Removing Advertisements

Fast Cars Dealer may suspend or remove advertisements where there are reasonable grounds to believe that an advertisement:

  • is fraudulent;
  • contains materially inaccurate or misleading information;
  • infringes another person's rights;
  • breaches these terms;
  • creates a regulatory or legal risk; or
  • relates to unlawful activity.

We may request supporting information from the dealer before restoring an advertisement.

11. Complaints

Complaints concerning a vehicle purchased from an independent dealer should normally be directed to the selling dealer.

Complaints concerning the operation of the Fast Cars Dealer marketplace should be sent to Fast Cars Dealer using the contact information displayed on the website.

12. Changes

We may update these terms where reasonably necessary to reflect changes to our marketplace, applicable law or regulatory requirements.

Material changes will be communicated or displayed on the website where appropriate.

13. Governing Law

These terms are governed by the laws of England and Wales, subject to any mandatory rights that apply under applicable law.
